The Employment Rights Act 2025 introduces significant changes to union recognition and workers’ rights. Effective April 6, 2026, unions will no longer need to demonstrate that most workers in a proposed bargaining unit support recognition. This marks a pivotal shift in labor relations, as the requirement for petitions or similar evidence for union recognition has been removed.

Under the new provisions, when recognition is decided by ballot, unions will only need a simple majority of votes cast, eliminating the former 40% support requirement for union recognition. These changes are expected to make it easier for unions to gain recognition and advocate for workers’ rights.

In addition to union recognition changes, the Act also addresses workers’ rights more broadly. Workers will now be able to claim statutory sick pay as soon as they become unwell, a significant improvement for employee welfare. Furthermore, workers are entitled to paternity and parental leave from the first day of employment, although parental leave will be unpaid.

Despite these advancements, some provisions have raised concerns. Paid leave has been deemed an ‘unaffordable’ commitment under the new law, which has led to criticism from labor leaders. Sharon Graham, leader of the Unite union, expressed disappointment, stating that Labour’s workers’ rights plans were now a “burnt out shell.”

Graham further remarked, “We are affiliated to Labour, but it’s harder and harder to justify that if they’re not backing workers.” Critics argue that most of the measures are watered down versions of the promises Labour made before the last general election, particularly regarding the commitment to end fire and rehire practices and zero hours contracts.

As these changes come into effect, observers are closely monitoring the response from both unions and employers. The updated CAC Application and Response procedures for new applications submitted on or after April 6, 2026, will also be a focal point for discussions on labor relations moving forward.

Details remain unconfirmed regarding how these changes will be implemented in practice, but the implications for workers’ rights and union dynamics are already sparking debate across the UK.
